Privacy policy


This policy is drawn up in French, the language of the site’s legal notices. The French version is the reference text and prevails in the event of any discrepancy; this English translation is provided for convenience only.

Definitions:

Customer: any professional or natural person having legal capacity within the meaning of articles 1123 et seq. of the French Civil Code, or any legal entity, visiting the site governed by the general terms set out below.

Content: all the elements making up the information present on the Site, in particular text, images and video.

Customer information: hereinafter referred to as “Information”, meaning all the personal data that ivstore.fr may hold in order to manage your account and our customer relationship, and for analysis and statistical purposes.

User: an internet user browsing the ivstore.fr site, whether or not they log in. Personal information: “information which, in any form whatsoever, directly or indirectly allows the identification of the natural persons to whom it applies” (article 4 of French Act no. 78-17 of 6 January 1978). The terms “personal data”, “data subject”, “processor” and “sensitive data” have the meaning given to them by the General Data Protection Regulation (GDPR: no. 2016-679).

2. General terms of use of the site and of the services offered:

The Site is a work of the mind protected by the provisions of the French Intellectual Property Code and by the applicable international regulations. The Customer may not, in any manner whatsoever, re-use, assign or exploit for their own account all or part of the elements or works of the Site. Use of the ivstore.fr site implies full and unreserved acceptance of the general terms of use described below. These terms of use are liable to be amended or supplemented at any time, and users of the ivstore.fr site are therefore invited to consult them regularly. Likewise, the legal notices may be amended at any time: they are nonetheless binding on the user, who is invited to refer to them as often as possible. This website is normally accessible to users at all times. It is updated regularly by its teams and partners. ivstore.fr may nevertheless decide to interrupt the service for technical maintenance, in which case it will endeavour to notify users beforehand of the dates and times of the work.

3. Description of the services provided:

The purpose of the ivstore.fr site is to sell services. ivstore.fr endeavours to provide information on its site that is as accurate as possible. However, it may not be held liable for omissions, inaccuracies or shortcomings in updating the site, whether caused by itself or by the third-party partners who supply that information. All the information given on the ivstore.fr site is provided for guidance only and is liable to change. Furthermore, the information appearing on the ivstore.fr site is not exhaustive. It is given subject to any changes made since it was published online.

4. Contractual limitations on technical data:

The site uses JavaScript technology. The ivstore.fr site may not be held liable for any material damage connected with its use. Furthermore, the user of the site undertakes to access the site using recent equipment that is free of viruses and a recent, up-to-date browser. The ivstore.fr site is hosted by a provider within the territory of the European Union, in accordance with the provisions of the General Data Protection Regulation (GDPR: no. 2016-679). The aim is to deliver a service with the best possible availability. The host ensures the continuity of its service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting service for the shortest possible periods, in particular for maintenance, for the improvement of its infrastructure, in the event of a failure of its infrastructure, or if the Services generate traffic deemed abnormal. Neither ivstore.fr nor the host may be held liable in the event of a malfunction of the internet network, of telephone lines, or of computer and telephone equipment, in particular where connected with network congestion preventing access to the server.

5. Intellectual property and infringement:

ivstore.fr owns the intellectual property rights and holds the rights of use in all the elements accessible on the website, in particular the text, images, graphics, logos, video, icons and sounds. Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without the prior written authorisation of ivstore.fr.Any unauthorised exploitation of the site or of any of the elements it contains will be deemed to constitute infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitations of liability:

ivstore.fr acts as the publisher of the site. ivstore.fr is responsible for the quality and truthfulness of the content published. ivstore.fr may not be held liable for direct or indirect damage arising from the use of its site and/or caused to the user’s equipment when accessing the ivstore.fr website, and resulting either from the use of equipment that does not meet the specifications set out in point 4, or from the occurrence of a bug or an incompatibility.

7. Management of personal data:

The Customer is informed of the regulations concerning marketing communications, of the French Act of 21 June 2004 on confidence in the digital economy, of the French Data Protection Act of 6 August 2004, and of the General Data Protection Regulation (GDPR: no. 2016-679).

7.1 Controllers of the collection of personal data:

For the Personal Data collected when the User creates their personal account and browses the Site, the controller of the Personal Data is SAS NEW IVS. Ivstore.fr is represented by SAS NEW IVS, its legal representative. As the controller of the data it collects, ivstore.fr undertakes to comply with the applicable legal provisions. In particular, it is responsible for establishing the purposes of its data processing, for providing its prospects and customers, on the basis of their consent, with full information about the processing of their personal data, and for maintaining a record of processing activities that reflects reality. Whenever ivstore.fr processes Personal Data, ivstore.fr takes all reasonable steps to ensure that the Personal Data is accurate and relevant to the purposes for which ivstore.fr processes it.

7.2 Purpose of the data collected:

ivstore.fr may process all or part of the data:

  • to enable browsing of the Site and the management and traceability of the services ordered by the user: connection and usage data, invoicing, order history, etc.;
  • to prevent and combat computer fraud (spamming, hacking, etc.):
  • the computer equipment used for browsing, the IP address, the password (encrypted);
  • to improve browsing on the Site: connection and usage data;
  • to carry out optional satisfaction surveys on ivstore.fr;
  • your email address: to run communication campaigns. ivstore.fr does not sell your personal data, which is therefore used only where necessary or for statistical and analytical purposes.

7.3 Rights of access, rectification and objection:

In accordance with the applicable European regulations, Users of ivstore.fr have the following rights:

  • the right of access (article 15 GDPR) and rectification (article 16 GDPR), updating and completion of Users’ data;
  • the right to have Users’ personal data blocked or erased (article 17 GDPR) where it is inaccurate, incomplete, ambiguous or out of date, or where its collection, use, disclosure or storage is prohibited;
  • the right to withdraw consent at any time (article 13-2c GDPR);
  • the right to restriction of processing of Users’ data (article 18 GDPR);
  • the right to object to the processing of Users’ data (article 21 GDPR);
  • the right to portability of the data Users have provided, where that data is subject to automated processing based on their consent or on a contract (article 20 GDPR);
  • the right to determine what becomes of Users’ data after their death and to choose to whom ivstore.fr must (or must not) disclose their data, being a third party they have designated beforehand. As soon as ivstore.fr becomes aware of the death of a User and in the absence of instructions from them, ivstore.fr undertakes to destroy their data, unless retention proves necessary for evidential purposes or in order to comply with a legal obligation. If the User wishes to know how ivstore.fr uses their Personal Data, to ask for it to be rectified, or to object to its processing, the User may contact ivstore.fr in writing at the address given in the “Contact” form. In that case, the User must indicate the Personal Data they would like ivstore.fr to correct, update or delete, identifying themselves precisely with a copy of an identity document (identity card or passport).

Requests for the deletion of Personal Data will be subject to the obligations imposed on ivstore.fr by law, in particular as regards the retention or archiving of documents. Finally, Users of ivstore.fr may lodge a complaint with the supervisory authorities, and in particular with the French data protection authority (CNIL) at: https://www.cnil.fr/fr/plaintes.

7.4 Non-disclosure of personal data:

ivstore.fr refrains from processing, hosting or transferring the Information collected about its Customers to a country outside the European Union or recognised as “inadequate” by the European Commission without first informing the customer. That said, ivstore.fr remains free to choose its technical and commercial processors, provided that they offer sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: no. 2016-679). ivstore.fr undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not disclosed to unauthorised persons. However, should an incident affecting the integrity or confidentiality of the Customer’s Information come to the attention of ivstore.fr, it must inform the CNIL as soon as possible and notify it of the corrective measures taken. Furthermore, ivstore.fr collects no “sensitive data”. The User’s Personal Data may be processed by subsidiaries of ivstore.fr and by processors (service providers), solely in order to achieve the purposes set out in this policy. Within the limits of their respective duties and for the purposes recalled above, the main people likely to have access to the data of Users of ivstore.fr are the staff of our customer service department.

8. Incident notification:

Whatever efforts are made, no method of transmission over the internet and no method of electronic storage is completely secure. We are therefore unable to guarantee absolute security. Were we to become aware of a security breach, we would notify the users concerned so that they could take appropriate measures. Our incident notification procedures take account of our legal obligations, whether at national or European level. We undertake to inform our customers fully of all matters relating to the security of their accountand to provide them with all the information they need to help them meet their own regulatory reporting obligations. No personal information of a user of the ivstore.fr site is published without the user’s knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only in the event of the acquisition of ivstore.fr and of its rights could such information be transferred to the prospective purchaser, who would in turn be bound by the same obligation as regards the retention and amendment of the data vis-à-vis the user of the ivstore.fr site.

8.1 Security:

In order to ensure the security and confidentiality of Personal Data, ivstore.fr uses networks protected by standard measures. When processing Personal Data, ivstore.fr takes all reasonable steps to protect it against loss, misuse, unauthorised access, disclosure, alteration or destruction.

9. Hyperlinks, “cookies” and internet tags:

The ivstore.fr site contains a number of hyperlinks to other sites, put in place with the authorisation of ivstore.fr. However, ivstore.fr is not in a position to check the content of the sites thus visited, and accordingly accepts no liability in that respect.Unless you decide to disable cookies, you accept that the site may use them. You may disable these cookies at any time, free of charge, using the deactivation options offered to you and recalled below, bearing in mind that this may reduce or prevent access to all or part of the Services offered by the site.

9.1 “Cookies”:

The only cookie that is not strictly necessary and that the site places is the audience measurement cookie described in point 11.1. It is placed only after you have given your acceptance in the banner displayed on your first visit. You may change your choice at any time by clicking the “Cookies” link at the bottom of every page.

9.2 Internet tags:

ivstore.fr may occasionally use internet tags (also known as “tags”, action tags, single-pixel GIFs, clear GIFs, invisible GIFs and one-to-one GIFs) and deploy them through a web analytics partner that may be located (and may therefore store the corresponding information, including the User’s IP address) in a foreign country. These tags are placed both in online advertisements that allowinternet users to reach the Site, and on the various pages of the Site. This technology enables ivstore.fr to assess visitors’ responses to the Site and the effectiveness of its activities (for example, the number of times a page is opened and the information consulted), as well as the User’s use of the Site.The external provider may collect information about visitors to the Site and to other websites by means of these tags, produce reports on the activity of the Site for ivstore.fr, and provide other services relating to the use of the Site and of the internet.

10. Applicable law and jurisdiction:

Any dispute in connection with the use of the ivstore.fr site is subject to French law. Except where the law does not permit it, exclusive jurisdiction is granted to the competent French courts.

11. Additional information:

11.1 “Google Analytics”:

The site uses Google Analytics 4, an audience measurement service provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland), which acts as a processor on behalf of SAS NEW IVS.

Purpose: to understand how the site is used (most-read pages, where visits come from, type of device) in order to improve its content and usability. This data is used solely for aggregated statistical purposes: it is not used for targeted advertising, for building profiles, or for tracking your browsing across other sites, and it is never sold.

Legal basis: your consent (article 6.1.a GDPR and article 82 of the French Data Protection Act). No Google script is loaded and no measurement cookie is placed until you have clicked “Accept” in the banner displayed on your first visit. If you decline, nothing is collected and no cookie is placed to record that refusal: your choice is stored in your browser’s local storage.

Withdrawing consent: you may change your choice at any time, without giving a reason, by clicking the “Cookies” link at the bottom of every page of the site. Withdrawal takes effect for the future only and does not affect the lawfulness of the collection already carried out.

Data processed, if you have consented:

  • the pages viewed, the date and time of the visit, its duration and interactions with the page (scrolling, outbound clicks, downloads);
  • the source of the visit (search engine, social network, direct link);
  • technical data: device type, operating system, browser, language, screen resolution;
  • approximate location data, limited to country and city, derived from your IP address;
  • a random identifier stored in a cookie, which makes it possible to recognise the same browser from one page to the next.

Your IP address is not retained by Google Analytics 4: it is used only for as long as it takes to derive an approximate location, then deleted. No data allowing you to be identified directly (name, email address) is transmitted to Google by this mechanism.

Retention periods: the measurement cookie has a lifetime of thirteen (13) months from your acceptance, in line with the CNIL’s recommendation; it is not extended on each visit. The associated audience data is retained by Google for fourteen (14) months, then deleted automatically. Aggregated statistics, which do not allow anyone to be identified, may be retained beyond that.

Transfers outside the European Union: the data is collected by Google Ireland Limited and may be transferred to servers located in the United States. These transfers are covered by Google LLC’s certification under the EU–US Data Privacy Framework, supplemented by the standard contractual clauses adopted by the European Commission.

You retain in respect of this data all the rights recalled in point 7.3, which may be exercised with SAS NEW IVS through the “Contact” form. You may also opt out of Google Analytics on every site you visit by installing the browser add-on offered by Google at https://tools.google.com/dlpage/gaoptout, or by enabling your browser’s “Do Not Track” setting. Google’s privacy policy is available at https://policies.google.com/privacy.

The site also uses Vercel Web Analytics, provided by Vercel Inc. This tool places no cookies, uses no persistent identifier and does not make it possible to track a visitor from one session to another; it therefore does not require consent and operates whether or not you accept the audience measurement described above.

11.2. “re-Captcha”:

We use the reCAPTCHA service from Google Inc. (Google) to protect form submissions on your site. This service is used to distinguish entries made by a human being from automated abuse. This involves sending the IP address and possibly other data required by Google for the reCAPTCHA service. To that end, your data will be passed to Google and used by their services. However, your IP address will first be shortened by Google within the member states of the European Union — or in other states that are party to the Agreement on the European Economic Area — and will thereby be anonymous. In certain exceptional cases, your full IP address will be transmitted to a Google server in the United States and shortened there. On behalf of the operator of this website, Google will use this information to assess your use of this service. The IP address provided by reCAPTCHA through your browser will not be merged with other Google data. This collection of data is subject to Google’s privacy policy. By using the reCAPTCHA service, you consent to the processing of data concerning you by Google, in the manner and for the purposes set out above.
